Browsing and using the website, including submitting details, contacting us, booking a lecture or purchasing a product or service, are subject to the terms set out in this document.

1. General

Welcome to the Elkana Bohbot website (the “Website”). Use of the Website constitutes acceptance of these terms. If you do not agree to all or part of them, please refrain from using the Website.

The Website operator may update the terms of use, privacy policy and cancellation policy from time to time. The updated version published on the Website will be the binding version.

2. About the Website

The Website provides information about Elkana Bohbot, his personal story, lectures, events, the book “738 Days in Hamas Captivity,” media content, articles, interviews, blog content and additional materials.

The Website may allow users to contact us, submit details, book lectures, submit media and collaboration inquiries, purchase books or products, and access third-party payment or service platforms.

3. Use of the Website

The Website may be used only for lawful and personal purposes. Users must not take any action through the Website that may harm the Website, its systems, other users or third parties.

Website content may not be copied, reproduced, distributed, published, transferred, publicly displayed or used commercially without prior written permission, except where expressly permitted by law.

4. Intellectual Property

All rights in the Website and its content, including design, text, photographs, videos, graphics, marks, names, files, articles and marketing content, belong to the relevant rights holders. Content may not be used beyond reasonable personal use of the Website without appropriate permission.

5. Purchases and Payments

Products or services may be purchased directly from the Website operator or through external payment services, stores and platforms. Where a user is redirected to an external platform, the transaction may also be subject to that platform’s terms of use and privacy policy.

Use of third-party services does not reduce any consumer rights granted by applicable law.

6. Cancellations and Refunds

Transaction cancellations will be handled in accordance with the Israeli Consumer Protection Law, 1981, its regulations and any other applicable law.

For distance-sale transactions, cancellation rights, cancellation periods, return procedures and refunds will be governed by applicable law and the nature of the transaction. Where the law permits cancellation fees, such fees may be charged at the rate permitted by law.

Where cancellation results from a defect, non-conformity, failure to supply on time or another breach for which the law does not permit cancellation fees, no cancellation fee will be charged. Nothing in this policy limits any consumer right granted by law.

7. Contact, Submission of Details and Privacy Notice

When completing a form on the Website, a user may provide information such as full name, telephone number, email address, inquiry type, inquiry content and any additional information the user chooses to provide.

Providing the information is voluntary and is not required by law. However, without the required details, we will not be able to handle the inquiry, respond to the user or provide the requested service.

In accordance with Section 11 of the Israeli Privacy Protection Law, 1981, the information is provided for the purpose of handling inquiries, contacting users, coordinating lectures and events, handling purchases and orders, media and collaboration inquiries, providing service, and operating and securing the Website, as relevant to the type of inquiry.

Controller of information collected through the Website: Elkana Bohbot, through the Website team. Privacy-related inquiries may be sent to omriharari74@gmail.com or by phone at 054-977-1033.

Information may be disclosed to external service providers acting on behalf of the controller, solely where required for Website operation, hosting, email and communications, security, payment processing or provision of the requested service, and to competent authorities where legally required.

A data subject has the right to request access to personal information about them under Section 13 of the law and, subject to the conditions of the law, to request correction of information that is inaccurate, incomplete, unclear or outdated under Section 14.

8. Purposes of Collection and Use

Personal information will be used only for legitimate purposes connected with Website operations and requested services, including responding to inquiries; coordinating lectures, events and collaborations; handling purchases and orders; providing service and support; documenting communications; preventing misuse and securing the Website; complying with legal obligations; and protecting legal rights.

Marketing or promotional communications will be sent only in accordance with applicable law and the required consent, where such consent is required. Merely submitting contact details for an inquiry does not, by itself, constitute consent to receive advertising.

Information will not be used for a new purpose that is incompatible with the purpose for which it was collected, unless permitted by law or after obtaining appropriate consent where required.

9. Technical Information and Information Not Submitted Through a Form

Some information is actively provided by users through forms, inquiries or purchases. For security and operational purposes, the Website server may retain basic technical information such as IP address, browser type, device type, access times and error logs.

Users are advised not to provide sensitive information or information that is unnecessary for handling the inquiry in free-text fields.

10. Cookies, Measurement and Tracking Technologies

The Website may use technical cookies required for proper operation, security and storage of basic preferences.

As of the last update to this policy, Google Analytics, Meta Pixel and similar advertising or tracking tools were not identified in the Website code. If non-essential analytics, advertising or tracking tools are introduced in the future, this policy will be updated and a consent or preference-management mechanism will be provided where required by law.

Users can delete or block cookies through browser settings. Blocking essential cookies may affect some Website functionality.

11. Disclosure to Service Providers and Third Parties

Personal information will not be sold to third parties. Information may be disclosed to external providers acting on our behalf only to the extent required to provide the service, such as hosting, email and communications, information-security, payment-processing or technology providers.

Some providers may process information outside Israel. In such cases, service providers and transfer mechanisms will be used in accordance with applicable law.

Information may also be disclosed where required by law, court order or competent authority, for the prevention of fraud or misuse, or for the protection of legal rights.

12. Data Retention and Minimization

Personal information will be retained only for as long as reasonably necessary for the purposes for which it was collected, handling inquiries, providing services, required business records, legal compliance and protection of legal rights.

When information is no longer required for those purposes, reasonable efforts will be made to delete it, anonymize it or minimize its retention, subject to technological capabilities and legal requirements.

13. Information Security

We take reasonable and customary technological and organizational measures designed to reduce the risk of unauthorized access to, use, alteration, copying or disclosure of personal information.

Access to information should be limited to those who require it for their role or to provide the service. However, no internet-based system is completely immune from intrusion, malfunction or security incidents, and absolute security cannot be guaranteed.

14. Personal Information Rights — Access and Correction

Subject to the Israeli Privacy Protection Law and applicable legal requirements, a person may request access to personal information held about them in a database under Section 13 of the law.

If the information is found to be inaccurate, incomplete, unclear or outdated, the person may request that it be corrected or deleted in accordance with the framework established by Section 14 of the law and subject to applicable legal conditions.

Privacy, access or correction requests may be sent to omriharari74@gmail.com. To protect the requester’s privacy, we may request reasonable information to verify identity before disclosing information or making a change.

15. Marketing Communications

The Website will not send advertising or marketing content except in accordance with applicable law and any required consent. Users may request at any time to stop receiving marketing communications through an unsubscribe mechanism included in the messages or by contacting us directly.

A service communication, response to a request or message required to provide a service requested by the user is not necessarily considered marketing communication.

16. Third-Party Links and Services

The Website may contain links to third-party websites, social networks or services. Use of those websites and services is subject to their own terms and privacy policies, and we do not control their activities.

17. Liability

The Website and its content are provided as is. Efforts are made to keep information accurate and up to date, but errors, changes, omissions or inaccuracies may occur.

Website content should not be regarded as legal, medical, professional or other advice. Subject to applicable law, the Website operator will not be liable for damage arising from unreasonable use of the Website, reliance on Website information or failure of a third-party service.

18. Website Availability

There is no commitment that the Website will be available at all times or free of errors. The Website operator may change, update, remove or discontinue content, services or parts of the Website as necessary.

19. Governing Law and Jurisdiction

Use of the Website and this document are governed by the laws of the State of Israel. Jurisdiction will be determined in accordance with applicable law.
